NEAT WHISTLER PROPERTY MANAGEMENT
VACATION RENTAL AGREEMENT & TERMS OF SERVICE
This Agreement is made by and between Neat Whistler Property Management Ltd. (Manager) and the Guest (Renter). By booking a property with Neat Whistler, the Renter acknowledges that they have read, understood, and agreed to be bound by the terms below.
1. ELIGIBILITY & GROUP COMPOSITION
1.1 Minimum Age & Identity: The primary Renter must be at least 25 years of age. This person must be the cardholder used for booking and must occupy the property for the full duration of the stay. We reserve the right to request ID upon check-in.
1.2 Guest Responsibility: The Renter accepts all responsibility for the behavior and actions of all persons (Invitees) on the premises.
1.3 Occupancy Limits: The group composition must match the booking application. No additional guests are permitted. Adults and children over 12 will be charged an additional $25 per night for the use of sofa beds.
1.4 No Commercial Use/Parties: All properties are in residential zones. Weddings, receptions, parties, or large gatherings are strictly prohibited. Discovery of such events will result in immediate eviction without refund.
2. PAYMENTS & CANCELLATION (Moderate Policy)
2.1 Payment Schedule:
Final Balance: Full balance is due 30 days prior to the arrival date. If the balance is not paid by this date, the credit card on file will be charged automatically. If payment fails, the reservation is subject to cancellation.
2.2 Cancellation Policy:
100% Refund: Cancellations made 30 days or more before check-in.
50% Refund: Cancellations made between 14 and 30 days before check-in.
No Refund: Cancellations made less than 14 days before check-in.
2.3 No Refunds for Late/Early Changes: No refunds will be issued for late arrivals, early departures, or "no-shows."
2.4 Force Majeure & Weather: Neat Whistler is not responsible for circumstances beyond our control, including but not limited to: adverse snow conditions, forest fire smoke, Sea-to-Sky Highway closures, acts of terrorism, pandemics, or utility interruptions. We strongly recommend purchasing Travel Insurance to cover these risks.
3. SECURITY DEPOSIT & PRE-AUTHORIZATION
3.1 Pre-Authorization: A damage pre-authorization hold will be placed on the credit card on file. This is not a charge unless damage occurs.
Studios/1 Bedroom: $500
1 Bedroom: $750
3+ Bedrooms: $1,000
3.2 Damages: Neat Whistler reserves the right to capture any part of this amount for damages, fines, missing items, or excessive cleaning. If damages exceed the pre-authorized amount, the Renter authorizes Neat Whistler to charge the credit card for the full cost of repairs/replacements.
4. CHECK-IN / CHECK-OUT
4.1 Arrival (4:00 PM): Early check-in is not guaranteed. Do not enter the property or park in the driveway before 4:00 PM unless explicitly approved. 4.2 Departure (10:00 AM): Adherence to checkout time is required for our cleaning teams.
Late Fee (15–60 mins): 50% of one night's rate.
Late Fee (Over 60 mins): 100% of one night's rate.
4.3 Checkout Procedures:
Load dirty dishes into the dishwasher and start the cycle.
Remove all garbage/recycling to designated complex bins.
Failure to follow these steps may result in an excessive cleaning fee ($65/hour).
5. WHISTLER SPECIFIC RULES & FINES
5.1 Noise Policy (Strict): Quiet hours are enforced by RMOW from 10:00 PM to 8:00 AM.
Fine: Excessive noise or police attendance will result in a $750 fine and potential eviction.
5.2 Smoking: Smoking of any kind (cigarettes, marijuana, vape) is NOT permitted inside, on balconies, or in common areas.
Fine: $750 plus the cost of deep cleaning/deodorizing.
5.3 Pets: No pets allowed unless the property is designated "Pet Friendly" and fees paid.
Fine: $750 for unapproved pets (carpet/upholstery cleaning).
5.4 Garbage & Wildlife: Whistler is bear country. Never leave garbage or food on balconies/patios.
Fine: $55 for improper disposal or attracting wildlife.
5.5 Bikes & Equipment: Please use only the designated storage.
6. DAMAGE MENU & INVENTORY
We believe in transparency. If you break it or stain it, you pay for it. All damage must be reported within 24 hours.
Sheet Stain/Damage: $30
Duvet Cover Stain/Damage: $60
Towel Missing/Soiled: $20
Kitchenware: $15+ per item
Carpet Cleaning (Partial): $150
Carpet Cleaning (Full): $475
Furniture Cleaning: $150
7. HOUSE SYSTEMS & UTILITIES
7.1 Plumbing: Do not put grease, coffee grinds, or food peelings in the garburator. Do not flush feminine products.
Note: If a clog is deemed misuse, the Guest is responsible for the plumber's call-out fee.
7.2 Hot Tubs: Hot tubs are serviced regularly. However, Neat Whistler does not guarantee water quality or jet performance due to potential mechanical failure. We will attempt to rectify issues immediately, but no refunds will be issued for hot tub downtime.
7.3 Supplies: Properties are stocked with a "starter pack" (toiletries, toilet paper, detergent). These are not replenished mid-stay unless requested (fees may apply).
8. LEGAL: LIABILITY, INDEMNIFICATION & ENTRY
8.1 Right of Entry: Neat Whistler personnel, agents, or vendors have the right to enter the Premises at any time for emergency maintenance, to verify compliance with this Agreement (e.g., noise complaints), or to protect the property. We will attempt to give reasonable notice where possible.
8.2 Unavailability: If the property becomes unavailable due to sale, fire, or unforeseen damage, Neat Whistler’s sole liability is to refund the Renter in full or attempt to relocate them to a comparable property. Neat Whistler assumes no further liability for travel costs or consequential damages.
8.3 Limitation of Liability: To the maximum extent allowed by law, Neat Whistler and the Property Owner are not liable for the Renter’s property left behind, nor for any consequential, incidental, or punitive damages from any cause whatsoever. Neat Whistler assumes no responsibility for any loss, injury, or death arising out of the use of the property, including the use of hot tubs, BBQs, slippery decks, or surrounding trails.
8.4 Indemnification: The Renter agrees to indemnify, defend, and hold harmless Neat Whistler Property Management and the Property Owner from all claims, disputes, litigation, judgments, costs, and attorney fees resulting from loss, damage, or injury to the Renter, their guests, or their personal property.
8.5 Chargebacks: The Renter agrees not to claim any chargebacks or credits from their credit card issuer for any fees charged to their credit card in accordance with this agreement, including advance rental payments, damage deposits, cancellation fees, or fines for violations (smoking/noise).
8.6 Errors and Omissions: Every effort is made to ensure accuracy in our descriptions. Neat Whistler is not responsible for changes in furnishing or décor by owners, or for errors in pricing descriptions.
8.7 Governing Law: This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia.
BY CONFIRMING THIS RESERVATION, THE RENTER AGREES TO ALL TERMS STATED ABOVE.
